WEEKENDFEELS TRAVELS TECHNOLOGIES LLP (hereafter referred to as 'Weekend Feels ','we', 'us', or 'our') provides an online platform that connects operators who have knowledge and experience with a particular travel destination or activity with Travellers seeking to experience such destinations and activities.


The Services are accessible at www.weekendfeels.com and any other websites through which Weekend Feels makes the Services available (collectively, the 'Site'). By using the Services, you agree to comply with the terms and conditions of these Terms of Service ('Terms'), whether or not you become a registered user of the Services.


Please carefully read these Terms and our Privacy Policy and Cancellation Policy, each of which is incorporated by reference into these Terms. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Services.


BROCHURE/WEBSITE INFORMATION

We take reasonable care in preparing the Brochure, price grid, price column webpages and other documents and in describing the services therein. However, we are not responsible / liable for any typographical / printing errors. Furthermore, Brochures may be printed several months in advance and the content may not always be fully updated. We therefore ask you to confirm the current information by contacting us.

Please note that the itinerary may have changed. The product and services displayed my have changed. The photos of meal/ Sightseeing are for reference only and may differ from actual meals / sights. Distance between places and temperature are approximate and can change depending on travel, road condition and climate changes.

We hereby disclaim all warranties and conditions with regard to this information, software, product, services and related graphic including all implied warranties and fitness for a particular purpose, title and non-infringement


PRICE GRID/PRICE COLUMN ITINERARY MAY CHANGE AT ANY TIME

We reserve the right to alter, amend, change or modify the tour package and itinerary before or during the tour. We will make reasonable efforts to notify you promptly of such changes/ events sufficiently in advance during booking or prior to departure of the tour. If such changes/events occur during the tour, our tour manager or local representative will inform you of the changes and we solicit your full co-operation in accepting such circumstantial changes. Therefore, no grievance regarding any itinerary / service changes which we are constrained to make, will be entertained from the tour participants during or after the tour. Such changes may be necessitated due to factor beyond our control such as Force Majeure events, strikes, fairs, festival sports event, weather condition traffic problems, closure of/ restricted entry at a place of sightseeing.


We will make reasonable efforts to keep the package of service unchanged. However, we shall not be responsible/liable to refund any amount or pay any compensation on account of any change in itinerary.


In case the alternate arrangements made are materially superior as compared to the ones described in the events page, we may charge extra for the same at the time of booking or in course of the tour.


PROMOTIONS / OFFERS / SCHEMES

Please note that promotional offers may have different terms and conditions which will be in addition to these terms and conditions and the requirements of the booking amount, payments, deadlines and mode of payment may be defined in such promotion which will be over and above these terms and conditions.

You will have to adhere to the payment schedule prescribed under such offers, promotions or schemes. If you fail to make the payment by due date and / or do not comply with all the terms and conditions of the offer, promotions or schemes, you would not be entitled to receive the benefit under such offer, promotion or scheme.

We shall have the absolute right to withdraw any scheme or discount at any time after such scheme or discount is published without prior intimation.


ELIGIBILITY

The Services can be used to facilitate the listing, reviewing, searching, comparing, meeting other people, entering contests and booking of tours and activities ('Group Tours'). Such Group Tours are included in Listings on the Services by Operators. You may view Listings as an unregistered visitor to the Services; however, if you wish to book a Tour or create a Listing, you must either register to create a Weekend Feels Account (defined below) or provide your email address. As stated above, Weekend Feels makes available a platform or marketplace with related technology for Travelers and Operators to meet online, write reviews, search, compare, enter contests and arrange for bookings of Group Tours. Weekend Feels is not an operator of tours, activities or other Group Tours, nor is it a provider of group tours or activities and Weekend Feels does not own, sell, resell, furnish, provide, manage and/or control any transportation, tour or travel services.


Weekend Feels only facilitates ticket booking and does not take any guarantee of any kind of permissions or tickets required in course of your tour itinerary. In the case, you miss and do not have required documents due to which you are not able to complete your tour, Weekend Feels or tour operator will not be liable for the act.


Weekend Feels's responsibilities are limited to facilitating the availability of the Services and serving as the limited agent of each Operator for the purpose of accepting payments from Travelers on behalf of the Operator.


BOOKING AND FINANCIAL TERMS FOR TRAVELERS

The Operators, not Weekend Feels, are solely responsible for honoring any confirmed bookings and making available any Group Tours reserved through the Services. If you, as a Traveler, choose to enter into a transaction with an Operator for the booking of a Group Tour, you agree and understand that you will be required to enter into an agreement (including releases) with the Operator and you agree to accept any terms, conditions, rules and restrictions associated with such Tour imposed by the Operator. However, you will receive the correct information made available by operator best to our knowledge. Operators may not change the Tour Cost after a booking has been confirmed unless the Operator asks for your Consent (changes might include additional services that you request from the Operator). If a booking has not yet been confirmed by the Operator, the Operator may change the price, details, add discounts, local payments and other services requested by you but the Operator must notify you of this change and you must consent to this change before the Operator can confirm your booking. You acknowledge and agree that you, and not Weekend Feels, will be responsible for performing the obligations of any such agreements, that Weekend Feels is not a party to such agreements, and that, with the exception of its payment obligations hereunder, Weekend Feels disclaims all liability arising from or related to any such agreements. You acknowledge and agree that notwithstanding the fact that Weekend Feels is not a party to any agreements between you and the Operator, Weekend Feels acts as the Operator's payment agent for the limited purpose of accepting payments from you on behalf of the Operator. Upon your payment of amounts to Weekend Feels which are due to the Operator, your payment obligation to the Operator is extinguished, and Weekend Feels will remit to the Operator the difference between the Tour Cost minus the Service Fee.


The Booking Page for a Tour will specify the Total Cost called the Tour Cost. As noted below the Operator is required to either confirm or decline the booking. If a requested booking is cancelled (i.e. not confirmed by the applicable Operator), any amounts collected by Weekend Feels will be refunded to such Traveller, depending on the selections the Traveller makes via the Site, and you acknowledge we will refund these amounts as soon as possible but the speed at which these amounts are returned to the source is often something you will need to discuss with our bank and is not something we are responsible for.


Once the Operators confirm your booking, Weekend Feels will collect the payment in accordance with the terms and conditions of these Terms and the pricing terms set forth in the applicable Listing. Please note that Weekend Feels cannot control any fees that may be charged to you by your bank related to Weekend Feels 's collection of payments, and Weekend Feels disclaims all liability in this regard.


ONE/ SOME MEMBERS(S) MAY ACCEPT TERMS AND CONDITION ON YOUR BEHALF

In case of more than one tour participants in a group, one person can accept the Terms and Conditions. It shall be deemed that the person has been duly authorized by all participants to consent, accept that Terms and Conditions on their behalf assuming full responsibility and accordingly it shall be deemed that all such tour participants have accepted the Terms and Conditions.


YOUR RESPONSIBILITY FOR YOUR DOCUMENTS AND POSSESSIONS

You will have to take the risk and responsibility of all your baggage, belongings, currency, valuables, documents and personal effects (collectively 'baggage') at all times during the tour.

In view of what is stated above, please carefully note that:

  1. We shall not be responsible or liable for any loss or damage in respect of your baggage etc. or their content whether due to theft, accident, negligence or otherwise.
  2. We shall not be responsible / liable for any cancellation or curtailment of your tour compelled by any such loss of baggage etc. and we shall pay no compensation or refund to you.

it is advisable that you do not carry valuables on the tour. If your baggage / valuable is lost or misplaced at any time during the course of your tour it is your responsibility / liability to take all the appropriate action to file complaint with concerned authorities, including police.


HEALTH

Please note that your health is entirely your risk and responsibility. Our tours are suitable for persons of reasonable fitness. They may not suit persons who have special need or requirement whether due to age, medical conditions or otherwise.

It shall be your duty to inform us in writing in case you have any condition that may affect your ability to fully enjoy out tour arrangements or where the interests of other tour participants may ne adversely affected by such conditions. Under such conditions we may decline to accept you or continue you on that tour.

We reserve the right (without obligation) to ask you to undergo medical tests and to provide written certification of your medical fitness before departure or at any time during the tour and if you fail to undergo such tests or fail to provide such certificates, we may decline to accept you or continue you on that tour. Our action in this regard may be guided not only by concern for your health but also the convenience and health of the other tour participants.

However, it is not our obligation to check your medical condition and if you suffer any injury or aggravation on the tour or if you are unable to enjoy / complete the whole or any part of the tour due to your medical condition, we shall not be responsible / liable to compensate you nor to refund any amount to you nor to pay your medical expenses. If any adventure sports are included in the package, you shall avail of the same at your own risk having regard to your medical condition. We shall not be liable for any death, injury or other loss due to your participation in such adventure sports and any release from that you may be required to sign for such person / service provider / club / association / organization hobbyist / institution will be binding.


IF TRAVELERS WANT TO CHANGE YOUR WEEKEND GETAWAY PLAN

After you make a full or partial payment, if you wish to change your travel arrangements in any way (e.g. your chosen departure date or accommodation), we will do our utmost to make these changes but it may not always be possible. Any request for changes must be in writing from the person who made the booking. All cost incurred due to amendment will be borne by the traveler himself.

Date shift requests can be made only once latest by 24 hours before the event start date. However, once a date shift request has been fulfilled, further date shift and cancellation requests will not be entertained. In case of any cancellation request made after the date change, the entire money will be forfeited irrespective of the date it is requested on.


CANCELLATION POLICY

Cancellation policy may vary on the basis on events. Below conditions are applicable regardless of type of cancellation policy:

  • All cancellation requests should be made to booking@weekendfeels.com from the registered e-mail address only. It shall be mandatory to mention the booking ID in the cancellation request e-mail.
  • Cancellation Policy is not applicable for cancellation requests raised for a group of 10 or more members. Weekend Feels reserves all rights to take decision on these requests which may include 100% cancellation charges.
  • Cancellation Policy is not applicable for check-in on special days such as 31st December as decided by Weekend Feels Team. Weekend Feels reserves all rights to take decision on these requests which may include 100% cancellation charges.
  • Cancellation Policy is not applicable for cancellation requests raised for a booking made using refund voucher. In case a cancellation is requested for any booking which was made using refund voucher then there is no refund in any mode of payment such as Original Mode or Voucher or Cash regardless of date on which cancellation was requested.
  • In the event of unforeseen weather conditions, union issues, government restrictions, or any other circumstances beyond human control, certain trips or activities may be cancelled. In such cases, alternate feasible options will be provided. However, a cash refund will not be available.
  • Relaxed Cancellation Policy
    1. For cancellation requests that are made before 24 Hours of event start date, entire booking amount for the concerned event will be refunded and returned to the source within 7-14 business days.
    2. For cancellation requests that are made between 0 to 24 Hours of event start date, the user will be given single or multiple vouchers totaling the value equal to the entire amount for the concerned event. The said voucher will be sent via e-mail on the registered e-mail ID within 3 business days. The said voucher shall be valid for a period of 3 months from the date of its issuance and it cannot be clubbed with any other discount coupon or voucher.
    3. Above Clauses 1 and 2 are applicable both in case of payment of the entire amount as well as partial payment for the concerned event.
    4. For Cancellation requests that are made on or after the event start date, they are not entertained and non-refundable.
  • Moderate Cancellation Policy
    1. For cancellation requests that are made before 72 Hours of event start date, entire booking amount for the concerned event will be refunded and returned to the source within 7-14 business days.
    2. For Cancellation requests that are made within 72 hours or after the event start date, they are not entertained and non-refundable.


PARTIAL PAYMENTS OPTION

  1. Confirm your booking by paying Booking Amount as mentioned in the package details of the concerned event.
  2. Remaining of the total amount payable should be paid before the due date of the concerned event, failing which the booking shall stand cancelled.
  3. Remaining payment to be made via the payment link provided in the booking confirmation mail of the concerned event.
  4. If you choose to "pay at campsite" option, you have to pay the remaining amount at the campsite at the time of check-in. Your booking confirmation is subjected to payment of the full amount towards the booking.


CANCELLATION / AMENDMENT BY WEEKEND FEELS

We reserve our right to amend or cancel the tour booked by you, without assigning any reason. Such amendment or cancellation may be due to circumstances beyond our control. In such cases, we will offer you alternative tour dates / tour. If the alternative date / tour is not acceptable to you, we would refund the money as per our cancellation policy. We would not be responsible or liable to pay any compensation or damage or consequential loss of interest or to refund any other expense incurred to you.


UNFORESEEN CIRCUMSTANCES OPERATOR CANCELLATIONS AND REFUNDS

If an Operator cancels a confirmed booking made via the Services, Weekend Feels will refund any Payment for such booking to the applicable Traveler within a commercially reasonable time of the cancellation and the Traveler may receive an email or other communication from Weekend Feels containing alternative Listings and other related information. If the Traveler requests a booking from one of the alternative Listings, this will be treated like a new group tour booking. If an Operator cancel a confirmed booking and you, as a Traveler, have not received an email or other communication from Weekend Feels, please contact Weekend Feels at info@weekendfeels.com.


CANCELLATION OF THE TOUR UNDER FORCE MAJEURE EVENT

We do plan the arrangements in advance. It is unlikely that we will have to make any changes to your travel arrangements. Occasionally, we may have to make changes due to Force Majeure Events and we reserve the right to do so at any time before or during the trip.


If there are any changes, we will advise you of them at the earliest possible date before or during the trip based on the Force Majeure Events.


We also reserve the right under Force Majeure Events to cancel your travel arrangements / offer alternative dates / revise the itinerary before or during the trip. Any additional cost incurred due to the above-mentioned reasons will have to be borne by the traveler himself. There shall be no refund to the traveler under Force Majeure Events.


Force Majeure Event shall mean and include any circumstance beyond the reasonable control of Weekend Feels, including without limitation, any act of nature or the public enemy, accident, explosion, fire, storm, earthquake, flood, drought, perils of the sea, casualty, strikes, lock-outs, labor troubles, riots, sabotage, terrorist acts, embargo, war (whether or not declared), governmental actions, delay in issuance or processing of Visa/permit, change of laws and regulations, orders, or decrees, or other causes of like or different character beyond the control of Weekend Feels.


NO REFUND FOR UNUTILIZED SERVICES

It is clearly understood that there shall be no refund or compensation whatsoever for unutilized services. This general rule applies to all kind of non-utilization or under-utilization of tour services, whether of the whole or part of the tour and whether as a matter of your choice, or caused by your fault or compelled by circumstances such as ill health, weather, external forces etc.

As a consequence of the above rule, please note that no refund will be admissible in the following circumstances (amongst others):

  1. There would be no refund if you fail to join the group at the commencement of the tour or join the group later or leave the group before culmination of the tour for any reason whatsoever.
  2. There will be no refund if you fail to or are unable to utilize any of the services due to any reason such as late reporting, ill-health etc.
  3. There would be no refund if you terminate your participation in the tour due to your own fault, negligence or breach of these terms.


BOOKING AND FINANCIAL TERMS FOR OPERATOR

If you are an Operator and a booking is requested for your Group Tour via the Services, you will be required to either confirm or decline the booking using Weekend Feels's Messaging System within the specified timeframe (which is generally within 24 hours of when the booking is requested, as determined by Weekend Feels in its sole discretion) or the booking request will be automatically accepted. If you decide to decline the booking of a Tour within the specified timeframe, any amounts collected by Weekend Feels for the requested booking will be refunded to the applicable Traveller's source of payment. You understand and agree that once a Traveller requests a booking of your Group Tour, the price for such booking may not be altered after you confirm the booking without first obtaining the Travelers consent. If you have not yet confirmed the Traveller's booking you can amend the price, details, add discounts, food funds, single supplements and other local payment so long as you advise the Traveller of these changes before you confirm the booking to allow Travelers to consent to your changes.


When a booking is requested via the Services, we may share with you the first and last name and contact details of the Traveller who has requested the booking. The Deposit amount displayed on the booking page is set with mutual consent of Weekend Feels and You. Where applicable, Taxes may be charged in addition to the Group Tour Cost. The Group Tour Cost and applicable Taxes are collectively referred to in these Terms as the 'Total Cost'. The amounts due and payable by a Traveller solely relating to an Operator's Group Tour are the 'Tour Cost'. Please note that it is you and not Weekend Feels which determines the Tour Cost and you agree this Cost will be exactly the same Cost stated on your website.


APPOINTMENT OF WEEKEND FEELS AS PAYMENT AGENT FOR OPERATOR

Each Operator hereby appoints Weekend Feels as the Operator's limited agent solely for the purpose of collecting payments made by Travelers on behalf of the Operator. Each Operator agrees that payment made by a Traveller to Weekend Feels shall be considered the same as a payment made directly to the Operator and the Operator will make the Group Tour available to Traveller in the agreed upon manner as if the Operator has received the Part Payment. In accepting appointment as the limited authorized agent of the Operator, Weekend Feels assumes no liability for any acts or omissions of the Operator. Operators acknowledge and agree that Weekend Feels reserves the right, in its sole discretion, to introduce and collect other fees from you in accordance. Please note that Weekend Feels will provide notice of new fees via the Services, prior to implementing such new features.


In consideration for providing the Services, Weekend Feels collects a service fee only from Operators ('Service Fees'). A Service Fee is made up of the based upon a percentage of the amount of the Group Tour Cost which is determined mutually by Weekend Feels and operator.


Services Fees are deducted from the Group Tour Cost before remitting the balance to the Operator (please note that we will not be responsible for delays in remitting Group Tour Fees, which can vary based on the bank, currency, location, etc). Balances will be remitted by Weekend Feels to Operators via different payment methods described on the Site. Please note that for any payments by Weekend Feels, we will pay our bank's costs and you are responsible to pay your bank's costs. Except as otherwise provided herein, Service Fees are non-refundable.


EMPLOYEE / AGENT / VENDOR NOT AUTHORIZED TO CHANGE TERMS

No person including any of our employees, Agents or Franchisees has the authority to alter, amend, or waive any stipulation, representation, term or condition set forth in this document. Assurance if any, given by any of our employees, Agents, Franchisees or any other person, whether given verbally / in writing / by email / by SMS or otherwise, which is contrary to the Terms and Conditions shall not bind us, in any manner.


CONDITION OF OTHER THIRD-PARTY SERVICE PROVIDER

In the event you are booking through us a service provided by third party, the terms and conditions of such third-party operator, including their payment schedule, cancellation, refund etc. shall be applicable to you in addition to these terms and conditions.


LIABILITIES

Please go through the Terms and Conditions carefully to understand your rights, responsibilities, risk and the extent of our liabilities.

As earlier stated, being tour organizer we will not be responsible / liable for any loss, injury or damage in respect of life, limb or property, sickness, delay, discomfort, anxiety, service denial, service deficiency, additional expense incurred by you or for any direct, indirect consequential loss and /or damage of any kind suffered by you howsoever caused arising out of any act, omission, default of any contractor / supplier or of any servant or agent employed by the contractor / supplier or of any third person who may be engaged or concerned in the provision of accommodation, meals, transportation, entertainment, refreshment or any other service etc. comprising the tour package. In view of this, please note that we shall have no liability in the following circumstances (amongst others):

  1. Overbooking of seats by the vendor
  2. Loss of baggage
  3. Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and / or damage or any kind of theft howsoever / wherever / whenever caused
  4. Rudeness or unprofessional behavior of staff of the vendor partner
  5. Any kind of service denial or deficiency by any contractor / supplier


FURTHER, PLEASE NOTE THAT IN ANY CASE, OUR LIABILITY ARISING FROM THIS CONTACT SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THE TOUR. FURTHER, UNDER NO CIRCUMSTANCES SHALL WE HAVE ANY LIABILITY IN RESPECT OF ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSSES / DAMAGE WHATSOEVER.


As earlier stated, any loss or damage to your baggage will be borne entirely by you and we shall not be responsible / liable for the same in any manner. You may recover such damages by purchasing an appropriate insurance policy. We shall not be responsible and / or liable for any damage caused to you due to reasons beyond the control of the Weekend Feels (once Majeure / Vis Majeure).

We are not responsible / liable for any acts, omission or default of other tour participants which may result in injury, damage to your life / limb or property or interfere with enjoying any services to be provided on the tour.

The immunity provided under this contract to the Weekend Feels shall be available to Weekend Feels managers, including tour managers, employees, servants and agents but not to the contractors / suppliers selected by the Weekend Feels.

Please note that we will be entitled to retain custody of your documents or properties entrusted to us till we receive payment of all amounts that are due to us in relation to your booking travel.


FORCE MAJEURE

The Weekend Feels shall not be liable / responsible in any way to you for death, bodily injury, illness, damage, deficiency, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for our failure to commence. Perform and / or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by act of god, war or threat of war, declared war, war riots, mechanical breakdowns, acts of the public enemy, actual or threatened terrorist activity, act of terrorism, terrorism, hostilities civil disturbances, insurrections, industrial dispute, strikes, financial / economic slowdown and / or meltdown, accidents, explosions, implosions, fires, earth quacks, volcanic ashes, floods, transportation, embargoes, epidemics, interference by authorities, political disturbance, howsoever and wheresoever any of the same may arise or be caused, riot, insurrection and government restraint, extreme weather or any other cause whatsoever beyond the reasonable control of the Weekend Feels; or an event in which the supplier of service, even with all due care, could not foresee.


PRIVACY INFORMATION

We try to maintain the privacy of the personal information provided by you. However, it would be necessary for us to share this information, with our vendor partners and other service providers who would be providing you services during the tour. We would also be constrained to disclose such information if we receive an order of the court, a requisition form any government or statutory authority, subpoena, or where under any laws, rules or regulations, such disclosure becomes necessary.

You agree to let us photograph and / or video the tour and specifically you agree to let us photograph and / or video you in the course of the tour. You agree to let us publish such photographs / videos through all media including print media, social media, websites letters emails etc. You also agree to let us track usage statistics. You agree and accept that all such photographs and / or video and statistics are our absolute property and we have the unrestricted right to use them for any legitimate purposes including advertisement and commercial purposes. Further, you agree that if you share with us any photograph and / or video taken by you during the tour, we would be free to publish such photographs / videos through all media including print media, social media, websites letters emails etc.


USAGE OF THE MOBILE NUMBER, COMMUNICATION DETAILS OF THE USER BY WEEKEND FEELS

Weekend Feels will send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction or booking made by the User, via SMS, internet-based messaging applications like WhatsApp, voice call, e-mail or any other alternate communication detail provided by the User at the time of booking.

Weekend Feels may also contact the User through the modes mentioned above for any pending or failed bookings, to know the preference of the User for concluding the booking and also to help the User for the same.

The User hereby unconditionally consents that such communications via SMS, internet-based messaging applications like WhatsApp, voice call, email or any other mode by Weekend Feels are:

  • upon the request and authorization of the User;
  • 'transactional' and not an 'unsolicited commercial communication' as per the guidelines of Telecom Regulation Authority of India (TRAI), and
  • in compliance with the relevant guidelines of TRAI or such other authority in India and abroad.

The User will indemnify Weekend Feels against all types of losses and damages incurred by Weekend Feels due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous complaint raised by the User on Weekend Feels with respect to the communications mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.


COMMUNICATION

Communications transmitted to your email address on record shall be deemed to have been communicated to you even if returned undeliverable for any reason. All communication from you to the Weekend Feels has to be in writing, not orally.

Where you book directly with us, we will address communications to you at your email address provided by you while booking. Where you have booked through a Travel Agent, we will address communication to your travel agent, who made the booking on your behalf and the agent will be responsible for transmitting such communications to you. All money paid to the travel agent shall not constitute payment to us unless deposited by your agent with the Weekend Feels. We shall not be liable / responsible for any miscommunication, non-communication or delayed communication.
